1. About Revive Apex

“Revive Apex,” “we,” “us,” and “our” refer to Revive Apex LLC. “You” and “your” refer to the person using the website or purchasing a product.

2. Eligibility and authority

You must be at least eighteen years old, or the age of legal majority in your jurisdiction, to make a purchase. By placing an order, you represent that you have legal capacity to enter into a binding agreement and are authorized to use the selected payment method.

If you use the website on behalf of a business or organization, you represent that you have authority to bind that entity.

3. Product information and availability

We make reasonable efforts to display product descriptions, specifications, images, colors, prices, promotions, included items, and availability accurately. Packaging, appearance, manufacturing details, and specifications may change when the change does not materially reduce the product’s intended function or quality.

Website images are illustrative and may appear differently depending on lighting, display settings, and production variation. Products and promotions are subject to availability, quantity limits, and geographic restrictions.

4. Cosmetic products

Revive Apex topical products are cosmetics intended to cleanse, condition, moisturize, support the appearance of healthy hair and scalp, and improve cosmetic appearance. They are not drugs and are not intended to diagnose, treat, cure, mitigate, or prevent disease.

Individual results and tolerability vary. Review the ingredient list before use, perform a patch test when appropriate, avoid use on broken or irritated skin unless the label states otherwise, and discontinue use if irritation develops.

5. ApexLight 552

The ApexLight 552 is described as FDA-cleared, not FDA approved. Use it only according to the current user manual, treatment schedule, warnings, contraindications, and included instructions.

Do not use the device as a substitute for professional medical care. Consult a qualified healthcare professional before use when you have a medical condition, take photosensitizing medication, have a light-sensitivity disorder, are pregnant or nursing, have an implanted electronic device, or are uncertain whether use is appropriate.

Stop use and contact Revive Apex promptly if the device shows abnormal overheating, burning, smoke, electric shock, physical damage affecting safety, or an unexpected light-output malfunction.

6. Orders and acceptance

An order confirmation acknowledges receipt of your order but does not necessarily constitute final acceptance. We may decline or cancel an order for inventory errors, pricing errors, payment failure, suspected fraud, unauthorized resale, geographic restrictions, duplicate orders, legal or regulatory concerns, or other legitimate business reasons.

If we cancel an order after payment has been collected, we will issue the applicable refund to the original payment method.

7. Prices, taxes, and payment

Prices are shown in U.S. dollars unless stated otherwise. Applicable taxes, shipping charges, discounts, financing terms, and order totals will be displayed before purchase.

You authorize us and our payment processors to charge the selected payment method for the amounts disclosed at checkout. We do not directly store complete payment-card numbers when payment is handled by a third-party payment processor.

8. Pre-orders

A pre-order reserves expected future inventory and is not a promise of a guaranteed delivery date. ApexLight 552 pre-orders are also governed by the Pre-Order Policy, including the expected shipment window, launch-offer limits, cancellation rights, delay notices, and bundle terms.

Where an estimated shipment date changes materially, we will provide the notices and options required by applicable law.

9. Subscriptions and recurring purchases

Any subscription or recurring-purchase option will display the price, frequency, savings, renewal terms, cancellation method, and other material conditions before enrollment. By enrolling, you authorize recurring charges according to the terms presented at checkout.

You may cancel or manage a subscription using the method disclosed at enrollment. Cancellation applies to future renewal orders and may not stop an order already in final processing.

10. Promotions and discount codes

Promotions may be subject to start and end dates, inventory limits, customer limits, product exclusions, minimum purchases, geographic restrictions, and separate terms. Unless expressly stated, offers cannot be combined, exchanged for cash, transferred, or applied retroactively.

We may suspend or cancel a promotion affected by fraud, technical malfunction, unauthorized distribution, or a material error, while honoring completed qualifying orders where required by law.

11. Shipping, returns, and refunds

Order processing, delivery, damaged shipments, cancellations, return eligibility, bundle handling, return shipping, and refund timing are governed by our Shipping & Returns Policy.

12. Limited warranty

The ApexLight 552 is covered by the separately published Three-Year Limited Warranty. That written warranty controls warranty claims and remedies for covered device defects.

Nothing in these Terms limits warranty rights or consumer remedies that cannot lawfully be waived.

13. Accounts and account security

You are responsible for maintaining the confidentiality of your login credentials and for activity under your account. Provide accurate, current information and notify us promptly of suspected unauthorized access.

We may suspend or terminate an account used for fraud, abuse, unauthorized resale, interference with the website, violation of law, or violation of these Terms.

14. Reviews, feedback, and user content

If you submit a review, photograph, testimonial, comment, or other content, you represent that it is truthful, based on your genuine experience, does not violate another person’s rights, and does not contain unlawful, deceptive, defamatory, infringing, or confidential material.

You retain ownership of your content but grant Revive Apex a nonexclusive, worldwide, royalty-free license to host, reproduce, display, format, and use it in connection with the website, customer support, and marketing, subject to applicable law and our Privacy Policy.

We may moderate or remove content that violates these Terms, but we are not obligated to publish any submission.

15. Intellectual property

The Revive Apex name, logos, follicle icon, ApexLight 552 branding, website design, product photography, packaging artwork, text, graphics, and other materials are owned by or licensed to Revive Apex and are protected by intellectual-property laws.

You may use the website for personal, noncommercial shopping and informational purposes. You may not copy, reproduce, scrape, modify, distribute, sell, reverse engineer, create derivative works from, or commercially exploit website content without prior written permission.

16. Prohibited conduct

You may not:

• Use the website for unlawful, fraudulent, deceptive, or abusive activity
• Attempt unauthorized access to accounts, systems, data, or checkout functions
• Introduce malware, interfere with operation, or evade security controls
• Use bots or automated tools to manipulate inventory, promotions, reviews, or purchasing limits
• Impersonate another person or submit false order or claim information
• Resell products in violation of an applicable reseller or distribution restriction

17. Third-party services and links

The website may rely on third-party providers for payments, financing, hosting, analytics, fulfillment, shipping, communications, fraud prevention, and other services. Those providers may have separate terms and privacy notices.

Links to third-party websites are provided for convenience and do not constitute endorsement. Revive Apex is not responsible for third-party content, availability, security, or practices.

18. Website availability and disclaimers

We do not guarantee that the website will always be uninterrupted, error-free, secure, or available. To the fullest extent permitted by law, the website and its informational content are provided “as is” and “as available.”

Product warranties are limited to the express written warranties that accompany the applicable product. Some jurisdictions do not allow limitations on implied warranties, so certain limitations may not apply to you.

19. Limitation of liability

To the fullest extent permitted by law, Revive Apex will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from website use, delayed access, third-party services, or misuse of a product.

Nothing in these Terms excludes liability that cannot lawfully be excluded, including liability for fraud, willful misconduct, or personal injury caused by negligence where applicable law prohibits exclusion.

20. Indemnification

To the extent permitted by law, you agree to indemnify and hold Revive Apex harmless from third-party claims, losses, or expenses arising from your unlawful use of the website, violation of these Terms, infringement of another person’s rights, or misuse or unauthorized resale of a product.

21. Governing law and venue

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles, except where federal law or the mandatory law of your state applies.

Unless applicable law requires otherwise, disputes not resolved informally will be brought in the state or federal courts located in Orange County, Florida. These Terms do not require arbitration and do not waive a consumer’s right to bring an eligible claim in small-claims court.

22. Changes to these Terms

We may update these Terms prospectively to reflect legal, operational, product, or service changes. The revised version will be posted with a new effective date. Material changes will not retroactively reduce rights attached to a completed purchase unless required by law.

23. Severability and entire agreement

If a provision is held unenforceable, the remaining provisions remain in effect. These Terms, together with the Privacy Policy, Shipping & Returns Policy, Pre-Order Policy, written warranty, and terms shown at checkout, form the agreement governing the applicable transaction.
